Welcome to Parinama Enterprises Ltd t/a Next Gen Wealth’s website (the "Website").  This page (together with the documents referred to on it) sets out the terms and conditions (“Terms”) on which you may make use of the Website. 

By using the Website, you accept these Terms and agree to abide by them. If you do not agree to these Terms, please do not use the Website. 

These Terms apply to all visitors of the Website.

The Website is owned and operated by Parinama Enterprises Ltd t/a Next Gen Wealth, incorporated and registered in England and Wales, whose registered office is at 128 City Road, London, United Kingdom, EC1V 2NX (“Next Gen Wealth”, or “we”, “us”, or “our”). Our company registration number is 15562887. 

2. Definitions

“Intellectual Property Rights” means patents, rights in inventions, copyright and neighbouring and related rights, trade marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets), and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world;

“Third Party Sites” means websites, applications, platforms or other software operated by third parties.

3. The Website 

The Website provides visitors with information about the coaching and other services that we offer and provide (the “Services”). 

We take all reasonable steps to ensure that the information, material and content on the Website is correct, but we do not make any representations or give any warranties or undertakings in relation to the accuracy, completeness or fitness for purpose of any information, material and content on the Website.  The information, material and content on the Website is for information purposes and guidance only and should not be relied on or treated as a substitute for specific advice relevant to particular circumstances.

We reserve the right to add, change, modify, suspend or discontinue any part of the Website at any time and without notice.  As a result, there may be times when the Website is unavailable for use.

4. Your use of the Website

You agree that you will access the Website and use its contents solely for your own personal, non-commercial use.

You may use the Website for lawful purposes only.  You must not (nor attempt to):

  1. collect or harvest any information or data from the Website or our systems or attempt to decipher any transmissions to or from the servers running the Website;

5. Intellectual Property Rights

All Intellectual Property Rights in the Website (including, but not limited to, the Next Gen Wealth name and logo, design, text, artwork, graphics, videos, images, interfaces and other media) throughout the world belong to us (or our licensors), and these rights are licensed (not sold) to you. You have no Intellectual Property Rights in, or to, the Website other than the right to use them in accordance with these Terms.

You may not:

  1. copy, reproduce, republish, distribute, download, post, broadcast, transmit, make available to the public, or otherwise use any content on the Website in any way except for your own personal use; or

  1. systematically extract material from the Website or any content available through it, or in any other way exploit commercially all or any part of the Website or any content available through it, without our prior written permission.

6. We are not responsible for Third Party Sites you link to

The Website may contain links to other independent Third Party Sites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked and approved their content or their privacy policies (if any). 

You will need to make your own independent judgement about whether to use any such independent sites, including whether to buy any products or services offered by them. 

7. Limitation of Our Liability

We have taken appropriate care in the preparation of the Website, but we cannot guarantee that the Website is free from errors, malfunctions, defects, bugs and viruses, or that the Website will operate correctly and as expected, at any given time.  We shall not be liable for any loss or damage which occurs as a result of any virus, including without limitation any distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other materials.

We do not accept any responsibility and shall not be liable for any loss or damage whatsoever, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with:

  1. use of or reliance on any information, material and/or content on or made available in connection with the Website: or

  1. interruption or delay in access, use of, or inability to use or access, this Website.

Nothing in these Terms shall operate to exclude or limit in any way our liability to you where it would be unlawful to do so.  This includes liability for fraud and fraudulent misrepresentation. 

9.  Data Protection

You agree that when you use the Website, we may collect personal data from you. 

Next Gen Wealth will process personal data regarding you in accordance with its obligations under the UK GDPR (as defined in section 3(10) of the Data Protection Act 2018), the California Consumer Privacy Act, the California Privacy Rights Act (each, if applicable), all other data protection laws applicable in the UK from time to time and (if applicable) the General Data Protection Regulation ((EU 2016/679). 10. Termination

Next Gen Wealth reserves the right, in its sole discretion, to terminate your access to all or part of this Website with or without notice.

11. Other Terms

We may update these Terms from time to time, and will publish the updated Terms on the Website.  Please check these Terms of Use regularly. All changes will take effect as soon as we publish the updated Terms. 

Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

If either we or you have any right to enforce these Terms against the other, that right will not be lost even if the person who has the right delays enforcing it, or waives their right to enforce it in any instance.  

Other than as set out in these Terms, these Terms are not intended to grant rights to anyone except you and Next Gen Wealth, and in no event shall these Terms create any third party beneficiary rights. Furthermore, the rights to terminate, rescind, or agree to any variation, waiver, or settlement of these Terms are not subject to the consent of any other person.

12. Which laws apply to these Terms and where you may bring legal proceedings

These Terms (and any non-contractual disputes/claims arising out of or in connection with them) are governed by the law of England and Wales and you agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims arising out of or in connection with these Terms or their subject matter or formation.
